Terms of Service

1. Agreement

These Terms of Service govern your use of eievarm.com and the Elevarm agricultural advisory platform (the "Service") operated by PT Elevarm ("the Company") (Jl. Raya Bogor KM 30, Depok, Jakarta, West Java 16911, Indonesia). By registering for an account or using the Service, you accept these Terms. Nothing in these Terms limits any statutory rights you hold under the laws of your country of residence.

The Service is designed for use by Indonesian smallholder farmers, agricultural input dealers, and partner organisations. The Petani and Petani Pro tiers are intended for individual farmers; the Mitra tier is intended for agricultural businesses operating in Indonesia.

2. Accounts and Eligibility

• You must be of legal age in Indonesia (18 years or older) or have parental or guardian consent to use the Service.
• Mitra (dealer) accounts must represent a lawfully operating business.
• You are responsible for keeping your account credentials secure and for all activity under your account.
• You agree not to use the Service unlawfully, to interfere with its operation, or to attempt unauthorised access to any system or data.

3. Agricultural Recommendations

Elevarm provides AI-generated agronomic recommendations (planting calendars, fertilizer dosing, harvest timing, variety suggestions) calibrated to West Java field conditions. These recommendations are advisory in nature. Farming decisions involving significant expenditure or land use remain your responsibility. The Company does not warrant that any recommendation will produce a specific yield outcome, as field conditions, weather, and pest events outside the model's inputs can affect results.

We update our prediction models as we receive more field data. Older recommendations may not reflect the current model's outputs; we encourage users to retrieve fresh advisories each planting season.

4. Input Marketplace and Orders

Input orders placed through the Elevarm platform are fulfilled by Mitra partner dealers. PT Elevarm facilitates the order connection but the sale contract for physical agricultural inputs (seeds, fertilizer, crop protection) is between you and the fulfilling Mitra dealer. Pricing displayed on the platform reflects dealer-listed prices and may change between planting seasons.

5. Use of the Service

• You may not scrape, reverse-engineer, or systematically copy the Service or its underlying data except as permitted by mandatory law.
• You may not use automated tools to generate artificial traffic or to extract agronomic model outputs at scale.
• You may not use the Service in a manner that could harm other users, Mitra dealers, or buyers connected through the platform.

6. Intellectual Property

The Service, including the Elevarm agronomic models, software, brand assets, and Field Journal content, is owned by the Company or its licensors and is protected under Indonesian and international intellectual property law. We grant you a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose: receiving agricultural advisories, placing input orders, and (for Mitra users) managing your connected farmer network.

Your plot data and agronomic records remain yours. The Company holds a licence to process that data to provide the Service as described in our Privacy Policy.

7. User Content

You are responsible for the accuracy of any information you submit to the platform (soil type, yield records, plot locations). You grant the Company a limited licence to use, store, and process this content to provide the Service. We do not use your plot data to train models for any third party or for purposes unrelated to Elevarm's agricultural advisory mission.

8. Disclaimers

The Service is provided on an "as is" and "as available" basis. The Company disclaims all warranties to the maximum extent permitted by applicable law, including warranties of merchantability, fitness for a particular agricultural purpose, and uninterrupted availability. This disclaimer does not affect any mandatory consumer rights you hold under Indonesian law or the law of your country of residence.

9. Limitation of Liability

To the maximum extent permitted by applicable Indonesian law, the Company's total liability for any claim arising from or related to the Service will not exceed the amount you paid to the Company in the three months preceding the claim, or USD 100, whichever is greater. This limit does not apply to liability that cannot be excluded under mandatory law.

10. Indemnification

You agree to indemnify and hold harmless the Company from any claims, losses, or expenses (including reasonable legal fees) arising from your use of the Service in violation of these Terms or your infringement of any third-party right.

11. Termination

The Company may suspend or terminate your access for breach of these Terms or for conduct that harms other users or the platform's operation. You may close your account at any time by contacting us. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability) will continue to apply.

12. Governing Law and Disputes

These Terms are governed by the laws of Indonesia. Disputes arising from or related to these Terms or the Service are subject to the non-exclusive jurisdiction of the competent courts in Jakarta, Indonesia, without prejudice to any mandatory consumer-protection rights you hold under the law of your country of residence.

13. Changes and Contact

The Company may update these Terms. Material changes will be posted with a revised "Last updated" date, and we will provide notice through the platform where practical. Continued use after a change constitutes acceptance. For questions:
